Examples of personally identifying information might include a person\u2019s contact information like their phone number or residential address, job information, family member details, social security number, etc. Doxxing usually has malicious intent behind it.\u00a0<\/p>\n\n\n\n<p>Under California law, it doesn&#8217;t matter how doxxing information is distributed. However, this is only if the perpetrator faces a misdemeanor charge. Depending on the severity of the crime, the violation may be charged as a felony.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"making-criminal-threats\">Making criminal threats<\/h3>\n\n\n\n<p>It\u2019s not unusual for someone who is doxxed to start receiving threats.&nbsp;<\/p>\n\n\n\n<p>In California, this crime is known as making criminal threats. It is defined in Penal Code <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=PEN&amp;sectionNum=422.\" target=\"_blank\" rel=\"noreferrer noopener\">422<\/a> as when a person threatens to commit a crime that can cause death or significant bodily injury to another person or that person\u2019s immediate family. This still qualifies as a crime even if no physical act occurs.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh7-us.googleusercontent.com\/5Kt89dA9cYA4fdOFLMMdFQ8U1ybO299JD0v-GXFwtPPGQa5H3zk3JKxEhQp1tLCBLwhcydqYw7Z8PxWUhkRUP88lZOKr5OvMaYpnSKWPgt2FWUsghDdu1M9nMv5bYwxI47Bg9QhAwmM1pahfHDrexAA\" alt=\"Section 422 of California Penal Code\"\/><\/figure>\n\n\n\n<p>The threat can be made verbally or through electronic communication, like email or text messages.&nbsp;<\/p>\n\n\n\n<p>Criminal threats can be prosecuted as either a misdemeanor or a felony. For misdemeanors, the maximum penalty is one year in county jail. For felonies, the sentence can be up to three years in state prison. This punishment can include a fine of up to $10,000 and probation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"making-annoying-phone-calls\">Making annoying phone calls<\/h3>\n\n\n\n<p>Once a doxxer has your phone number, they or anyone else can make annoying or threatening phone calls.&nbsp;<\/p>\n\n\n\n<p>In California, making phone calls or electronic communications with the intent to annoy is subject to Penal Code <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=653m.&amp;lawCode=PEN\" target=\"_blank\" rel=\"noreferrer noopener\">653m<\/a>. This includes calls or communications that are obscene, threatening, or repeatedly harassing. Calls made in good faith or for legitimate purposes are excluded.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh7-us.googleusercontent.com\/RJOAC7ybQKJKOMAqg451PfpcG5CLFC-vdd3ZpuRDk_62X0ePGgSbaLQ7o3bcdoeyYqjP3BS_dOIVEy7HiLJ9VO6v_PE3EKo1TjTCZVbvqGYL6v_YcGSx6cSt1h8iMEJv4pjas2L6KTnOI8T_NL8t9Ug\" alt=\"Section 653m of California Penal Code\"\/><\/figure>\n\n\n\n<p>Violating this law is punishable with a sentence of up to six months in a county jail and a fine of up to $1,000. It&#8217;s a misdemeanor crime, and judges can impose other conditions of probation beyond the expected punishment.&nbsp;<\/p>\n\n\n\n<p>An important aspect of California&#8217;s law is that not every communication deemed annoying qualifies as criminal. The communication must also:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Contain obscene language or threats.<\/li>\n\n\n\n<li>Be part of an excessive series of repetitive calls.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"is-doxxing-illegal-at-the-federal-level\">Is Doxxing Illegal at the Federal Level?<\/h2>\n\n\n\n<p>In the US, <a href=\"https:\/\/joindeleteme.com\/doxxing\/is-doxxing-illegal\/\" target=\"_blank\" rel=\"noreferrer noopener\">doxing is not currently illegal<\/a> at the federal level.&nbsp;<\/p>\n\n\n\n<p>Each state is responsible for setting its own laws, regulations, and punishments related to doxxing.&nbsp;<\/p>\n\n\n\n<p>However, some federal laws could punish doxxers. For example, <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/119\" target=\"_blank\" rel=\"noreferrer noopener\">18 U.S.Code \u00a7119<\/a> is a federal statute under which it\u2019s illegal to share restricted personal information about covered persons (e.g., grand or petit jurors, witnesses in a federal criminal investigation, etc.).&nbsp;<\/p>\n\n\n\n<p>Some states, like <a href=\"https:\/\/joindeleteme.com\/doxxing\/is-doxxing-illegal\/is-doxxing-illegal-in-california\/\" target=\"_blank\" rel=\"noreferrer noopener\">California<\/a>, <a href=\"https:\/\/joindeleteme.com\/doxxing\/is-doxxing-illegal\/is-doxxing-illegal-in-illinois\/\" target=\"_blank\" rel=\"noreferrer noopener\">Illinois<\/a>, and <a href=\"https:\/\/joindeleteme.com\/doxxing\/is-doxxing-illegal\/is-doxxing-illegal-in-arizona\/\" target=\"_blank\" rel=\"noreferrer noopener\">Arizona<\/a>, have made doxxing illegal. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"how-to-protect-yourself-against-doxxing-in-california-and-elsewhere\">How to Protect Yourself Against Doxxing In California (And Elsewhere)<\/h2>\n\n\n\n<p>To protect yourself against doxxing, you need to reduce the amount of personal data that exists about you online.&nbsp;<\/p>\n\n\n\n<p>Few people realize how much of their personal information lives on the internet. To figure out how easy it would be for someone to find this information, try doxxing yourself.
