It includes broad definitions of covered entities and sensitive data types, as well as a strong private right of action. The combination of these features may make it the most significant new privacy law in the country.&nbsp;<\/p>\n\n\n\n<p>Washington State now joins Iowa, Indiana, and Tennessee, who have all signed new privacy legislation into law this year. California, Colorado, Connecticut, Utah, and Virginia have passed similar laws in the past few years. The Montana legislature also passed a comprehensive privacy law in April.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"our-take\"><strong>Our take:&nbsp;<\/strong><\/h3>\n\n\n\n<p>Washington\u2019s My Health, My Data Act is likely to be a significant source of concern for many companies. The Act is similar to Illinois\u2019 Biometric Information Privacy Act (BIPA), which has led to <a href=\"https:\/\/www.cnn.com\/2022\/09\/20\/tech\/illinois-biometric-law-bipa-explainer\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">billions of dollars lost<\/a> in class action settlements over the last few years, but imposes more operationally challenging obligations and has fewer limitations on applicability.&nbsp;<\/p>\n\n\n\n<p id=\"cybersecurity\"><\/p><hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"cybersecurity-update-municipal-agencies-healthcare-networks-under-fire\"><strong>Cybersecurity Update: Municipal Agencies, Healthcare Networks Under Fire<\/strong><\/h2>\n\n\n\n<p>Cybersecurity researchers are pointing to a growing trend of <a href=\"https:\/\/www.axios.com\/2023\/05\/16\/ransomware-us-cities-towns-local-government-hackers\" target=\"_blank\" rel=\"noreferrer noopener\">ransomware attackers targeting municipalities<\/a>. Since the beginning of 2023, there have been major disruptions in Oakland, CA, Dallas, TX, and Washington, DC, as well as smaller cities like Lowell, MA, and the suburbs of Detroit, MI. This month also saw attacks on the Federal <a href=\"https:\/\/www.reuters.com\/world\/us\/data-237000-us-government-employees-breached-2023-05-12\/\" target=\"_blank\" rel=\"noreferrer noopener\">Department of Transportation<\/a> and the <a href=\"https:\/\/archive.ph\/iKGdL\" target=\"_blank\" rel=\"noreferrer noopener\">DC Metro system<\/a>, highlighting growing cyber risks to public infrastructure.<\/p>\n\n\n\n<p>The healthcare sector has also become the exclusive target of some well-resourced ransomware groups like CLOP and LockBit. Attacks in this sector <a href=\"https:\/\/therecord.media\/ransomware-tracker-the-latest-figures\" target=\"_blank\" rel=\"noreferrer noopener\">peaked<\/a> at a record high in April. A recent breach of <a href=\"https:\/\/www.theregister.com\/2023\/05\/18\/pharmerica_data_breach\/\" target=\"_blank\" rel=\"noreferrer noopener\">PharMerica<\/a>, a pharmacy services provider, is one of the largest this year so far, exposing the data of over six million patients.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"our-take-1\"><strong>Our Take:&nbsp;<\/strong><\/h3>\n\n\n\n<p>With large ransomware payouts <a href=\"https:\/\/dataconnectors.com\/ransomware-attacks-payouts-are-declining\/\" target=\"_blank\" rel=\"noreferrer noopener\">in decline<\/a>, Russian cyber gangs appear to be dividing efforts between \u201cdisruption for disruption\u2019s sake\u201d and exfiltrating the most lucrative, sellable data. The public sector is ideal for the former and the healthcare industry for the latter.<\/p>\n\n\n\n<p id=\"workforce\"><\/p><hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"workforce-surveillance-receiving-greater-federal-scrutiny\"><strong>Workforce Surveillance Receiving Greater Federal Scrutiny<\/strong><\/h2>\n\n\n\n<p>The White House Office of Science and Technology Policy released a public <a href=\"https:\/\/www.whitehouse.gov\/ostp\/news-updates\/2023\/05\/01\/hearing-from-the-american-people-how-are-automated-tools-being-used-to-surveil-monitor-and-manage-workers\/\" target=\"_blank\" rel=\"noreferrer noopener\">request for information<\/a> on employer use of workforce monitoring technologies. This is usually an early indication of forthcoming policy proposals.<\/p>\n\n\n\n<p>Recent research indicates that even though pandemic-driven remote work opportunities have decreased, the use of employee surveillance tools <a href=\"https:\/\/cybernews.com\/privacy\/use-of-employee-monitoring-tools-up-nearly-50-since-2021\/\" target=\"_blank\" rel=\"noreferrer noopener\">has grown since 2021<\/a>. The types of technologies used have also become more invasive.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"our-take-2\"><strong>Our Take<\/strong><\/h3>\n\n\n\n<p>Few new state privacy laws (other than the <a href=\"https:\/\/www.sixfifty.com\/blog\/employee-data-now-subject-to-california-privacy-law\/#:~:text=Under%20the%20CPRA%2C%20employees%20have,in%20a%20physical%20office%20location.\" target=\"_blank\" rel=\"noreferrer noopener\">CCPA<\/a>) have included employee data protections so far.
