Forrester notes that new B2C startups, looking forward to a post-cookie world, are increasingly implementing measures for increased <a href=\"https:\/\/www.forbes.com\/sites\/theyec\/2022\/03\/14\/zero-party-data-is-the-new-oil\/\" target=\"_blank\" rel=\"noreferrer noopener\">zero-party data collection<\/a>, including direct \u2018pay-for-data\u2019 arrangements where customers are remunerated for voluntarily sharing specific kinds of personal information with brands.&nbsp; New apps featuring these pay-for-data arrangements include <a href=\"https:\/\/www.caden.io\/\" target=\"_blank\" rel=\"noreferrer noopener\">Caden<\/a>, <a href=\"https:\/\/mytiki.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">TIKI<\/a>, <a href=\"https:\/\/tapestri.io\/\" target=\"_blank\" rel=\"noreferrer noopener\">Tapestri<\/a>, and <a href=\"https:\/\/www.invisibly.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Invisibly<\/a>, each offering a range of benefits,&nbsp; from free access to paywalled media content, to direct cash rewards for access to users&#8217; mobile-device data.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"our-take\"><strong>Our Take<\/strong><\/h3>\n\n\n\n<p>First-Party Loyalty Programs\u2014many of which provide rewards and incentives for increased access to customer information\u2014<a href=\"https:\/\/joindeleteme.com\/incognito\/december-2022-loyalty-programs\/\" target=\"_blank\" rel=\"noreferrer noopener\">are nothing new<\/a>. But both B2C and B2B loyalty\/rewards programs are also increasingly being targeted by both <a href=\"https:\/\/www.restaurantbusinessonline.com\/marketing\/restaurants-urge-ftc-not-over-regulate-loyalty-programs\" target=\"_blank\" rel=\"noopener\">the FTC<\/a> as well as <a href=\"https:\/\/www.privacyworld.blog\/2022\/01\/loyalty-programs-in-the-california-ags-crosshairs-once-again\/\" target=\"_blank\" rel=\"noopener\">California&#8217;s<\/a> Attorney General&#8217;s office (newly empowered by CCPA) for abusive business practices as well as lack of transparency with end users.\u00a0 They have also been a popular target by <a href=\"https:\/\/www.nytimes.com\/2019\/05\/11\/business\/rewards-loyalty-program-fraud-security.html\" target=\"_blank\" rel=\"noopener\">hackers and data thieves<\/a> who see them as easy-to-exploit, one-stop-shops for troves of user personal information, as well as cash equivalent forms of data (like loyalty \u2018points\u2019 or coupon codes) that can be sold in dark-web exchanges. Whether these new business models will survive scrutiny in a regulatory environment demanding greater transparency remains to be seen.<\/p>\n\n\n\n<p id=\"consent\"><\/p><hr class=\"wp-block-separator has-alpha-channel-opacity\">\n\n\n\n<h2 class=\"wp-block-heading\" id=\"u-penn-study-argues-americans-cant-consent-to-uses-of-personal-data-they-fundamentally-dont-understand\"><a href=\"https:\/\/www.asc.upenn.edu\/sites\/default\/files\/2023-02\/Americans_Can&#039;t_Consent.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">UPenn Study Argues \u2018Americans Can\u2019t Consent\u2019 to Uses of Personal Data they Fundamentally Don\u2019t Understand<\/a> <\/h2>\n\n\n\n<p>UPenn\u2019s Annenberg School for Communication has released a research report arguing <a href=\"https:\/\/www.nytimes.com\/2023\/02\/07\/technology\/online-privacy-tracking-report.html\" target=\"_blank\" data-type=\"URL\" data-id=\"https:\/\/www.nytimes.com\/2023\/02\/07\/technology\/online-privacy-tracking-report.html\" rel=\"noreferrer noopener\">\u201cConsent\u201d has become a broken concept<\/a> in the online economy.&nbsp;&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>\u201cGenuine opt-out and opt-in consent requires that people have knowledge about commercial data-extraction practices as well as a belief they can do something about them\u2026discoveries from our survey paint a picture of an unschooled and admittedly incapable society that rejects the internet industry\u2019s insistence that people will accept tradeoffs for benefits and despairs of its inability to predictably control its digital life \u201d<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>The report makes a case that even recently-enacted state privacy regulatory frameworks (like California\u2019s and others) are insufficient in that they presume consumers have the ability to make informed and rational choices about data sharing.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"our-take-1\"><strong>Our Take<\/strong><\/h3>\n\n\n\n<p>The piece makes a case for <em>\u201ca paradigm shift in information-economy law and corporate practice,\u201d<\/em> which, while compelling as theory, has little likelihood of influencing lawmakers or business leaders, who \u2014even when sympathetic\u2014are constrained by the legal frameworks we already have. Furthermore, they have enough of a challenge to make incremental improvements to these legal frameworks, as ongoing <a href=\"https:\/\/www.theregister.com\/2022\/11\/15\/us_midterm_elections_privacy\/\" target=\"_blank\" rel=\"noopener\">debates around Federal data privacy laws like ADDPA<\/a> have shown.<\/p>\n\n\n\n<p id=\"AI\"><\/p><hr class=\"wp-block-separator has-alpha-channel-opacity\">\n\n\n\n<h2 class=\"wp-block-heading\" id=\"are-regulators-ready-for-the-ai-arms-race\"><a href=\"https:\/\/thehill.com\/policy\/technology\/3856207-the-ai-arms-race-is-on-are-regulators-ready\/\" target=\"_blank\" rel=\"noreferrer noopener\">Are Regulators Ready for the AI Arms Race?<\/a><\/h2>\n\n\n\n<p>With Microsoft\u2019s recent acquisition of OpenAI and <a href=\"https:\/\/blogs.microsoft.com\/blog\/2023\/02\/07\/reinventing-search-with-a-new-ai-powered-microsoft-bing-and-edge-your-copilot-for-the-web\/\" target=\"_blank\" rel=\"noreferrer noopener\">rapid implementation of its ChatGPT tool<\/a> into its Bing search-engine functionality (followed by Google\u2019s Me-Too launch of <a href=\"https:\/\/thehill.com\/policy\/technology\/3845903-google-unveils-bard-its-rival-to-chatgpt\/\" target=\"_blank\" rel=\"noreferrer noopener\">Bard<\/a>), <a href=\"https:\/\/www.reuters.com\/technology\/chatgpts-popularity-explodes-us-lawmakers-take-an-interest-2023-02-13\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawmakers <\/a>are coming to grips with the reality that technology is quickly moving beyond the scope of existing regulatory frameworks.&nbsp; While primary concerns at the moment are around issues of <a href=\"https:\/\/www.sciencetimes.com\/articles\/42119\/20230130\/deepfake-ai-undermine-national-security-exploited-autocracies-cyber-expert-warns.htm\" target=\"_blank\" rel=\"noreferrer noopener\">national security<\/a> and potential for spread of <a href=\"https:\/\/www.nytimes.com\/2023\/02\/08\/technology\/ai-chatbots-disinformation.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u2018disinformation\u2019<\/a>, data-privacy risks are also coming to the forefront, as <a href=\"https:\/\/gizmodo.com\/amazon-chatgpt-ai-software-job-coding-1850034383\" target=\"_blank\" rel=\"noreferrer noopener\">Amazon warns its employees<\/a> against use of the tools after discovering confidential company information appearing in ChatGPT results.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"our-take-2\"><strong>Our Take<\/strong><\/h3>\n\n\n\n<p> It&#8217;s unlikely DC will make any immediate changes to the current self-regulatory environment around AI tools until examples of adverse events using the technology make themselves apparent.&nbsp; But those examples may not be far-off; the <a href=\"https:\/\/oversight.house.gov\/release\/comer-opens-hearing-investigating-billions-lost-to-waste-fraud-and-abuse-in-pandemic-programs\/\" target=\"_blank\" rel=\"noreferrer noopener\">boom in government services fraud during the COVID pandemic<\/a> has prompted many in Congress to pay greater attention to how new technologies have enabled information abuse at scale, and rules around stricter identity authentication may eventually result in requirements that AI tools disclose themselves as such to 3rd parties.<\/p>\n\n\n\n<p id=\"webinar\"><\/p><hr class=\"wp-block-separator has-alpha-channel-opacity\">\n\n\n\n<h2 class=\"wp-block-heading\" id=\"3-personal-information-insights-to-help-companies-protect-themselves-against-hackers\">3 Personal Information Insights to Help Companies Protect Themselves Against Hackers<\/h2>\n\n\n\n<p>How does personal information removal help companies protect themselves against hackers?
